RESERVED TIME

Angela Hall Photography (“Photographer”) will reserve the times agreed upon and will not make any other reservations for the specific time frame. For this reason, all fees are due at the time of scheduling, and all payments are non-refundable even if the date is changed or becomes canceled for any reason. No photography images will be released to the client and no rights are granted until timely payment is made in full.

DAY OF THE SESSION

If you are late or not prepared for the session at the time scheduled, extra time will be charged under “Extra Time” herein, at the sole discretion of Angela Hall Photography.  (Please see Over all Appearance of the Property section below)

 

PAYMENT AND PACKAGES

Full payment of your session will be required on the day of shooting. You will not receive any images unless full payment of the entire package is made. Cash, online payment (such as PayPal, Square, etc.) or personal checks are accepted forms of payment. For checks, no retouching or work will be done until funds have been cleared. Returned checks are subject to a $35 charge. 

 

RECEIVING YOUR GALLERY

Once the session has been completed and full payment received, you should receive your gallery within the next Business date, unless otherwise agreed upon or an instance has occurred that in any way causes  Angela Hall Photography to be rendered unable to complete your gallery within that timeframe.  In such a case, you may be eligible to receive a refund at the discretion of Angela Hall Photography. (See REFUNDS)

 

RETOUCHING TIME AND PROCESS

If retouching is requested by the agent, such as virtual staging, the retouching process begins once gallery images to be retouched are selected. The time taken to choose proofs will serve as a factor in the retouching process. Clients who choose their proofs first will get their photos retouched first, regardless of when their photos were taken and which package they have.  Any approved retouched photos may not be considered for re-editing.  All changes are final once approved and any extra retouching desired by the client is subject to separate charges per revision.  All retouching requests must be paid in full before retouching begins. Extra time rates may apply.

 

EXTRA TIME

Any additional time spent due to the lateness of the client, retouching, or editing, that are not otherwise paid for under this Contract shall be charged at the rate of $25 per hour. Angela Hall Photography may elect to perform these services or refuse them, at its sole discretion. Client agrees to pay these services as invoiced and may be required to pay for these services ahead of their provision.

 

COLORING AND RETOUCHING

Basic retouching includes straightening lines, Flambient blended images, removing shadows, removing leaves and pine needles and debris from the rooftops. Basic retouching does not include things like physically removing trees, branches, water hoses, trash cans, garbage etc., or adding things to a photo.  The client may choose to pay per image for extra retouching. Extra time rates may apply.

 

SKY REPLACEMENTS

Clients may choose to have a sky replacement added to a photo. By default, the original sky will be given unless it is a cloudy day, in which the photographer will choose a blue sky overlay at no additional charge. If for any reason the client does not want their sky retouched, they will receive original tones brightened and edited slightly. If the client chooses to have the sky replaced, the client agrees to pay a separate charge per image (see EXTRA TIME) for additional sky choices to be presented. By choosing Angela Hall Photography you acknowledge the style and colors used and agree to allow the photographer to choose the colors for you.

 

UNEDITED PHOTOS/PHOTO POLICY

Client agrees that unedited photos will not be shared for any reason. The only unedited photos the Client will receive are the thumbnails for the proofs to choose for retouching. Client agrees not to post or otherwise share unedited photos. Only your retouched photos will be released. 

 

All outtakes and unedited photos are the property of Angela Hall Photography and are not to be shared, distributed or posted under any circumstances.

 

OVERALL APPEARANCE OF THE PROPERTY

The photographer is not responsible for preparing the property for photos. Please refer to the Property Preparation Sheet to ensure the session goes smoothly. It is ultimately your responsibility to make sure your property is ready for photos on the day of the shoot. The photographer is not responsible for the removal of unwanted items that may appear in the photos once the session has taken place during the editing process. If the photographer arrives at the designated time, and the property is not prepared for the shoot, and extra time is needed to complete the session, you will be charged for additional time and the charges are due at the time of the session.  (See EXTRA TIME)

 

REFUNDS

If you are not satisfied with your photos, you may be refunded half of the total package if the issue is caused by the Photographer and in the sole discretion of the Photographer. You will only be eligible if you have made this known to the photographer before any retouching is made and only if the photographer agrees that it is appropriate. If you choose to re-do your photos for any reason, it will be considered as a new session and you will need to purchase a new package. The session fee is non-refundable. In the event of an emergency, equipment failure or other unforeseen circumstance, and in the case the photographer cannot reschedule the session, the photographer will return any money paid shall have no further liability for any other damages including incidental or consequential damages of any nature whatsoever in contract or in tort. 

 

CLIENT’S USAGE

The Client is obtaining images for personal use only and shall not sell said images. It is not permitted to give photos to vendors having their products or setups photographed in order to use for advertising or promotion. No commercial use is granted by the issuance of print or digital photos. Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain the property of Angela Hall Photography and may not be used to sell to any other agent or entity.  You may use the gallery images to promote, advertise your listing on websites such as HAR, Zillow, Trulia, personal websites and Social Media platforms with proper credit due to Angela Hall Photography.

Client agrees the photos will not be tampered with, edited or manipulated in any way, such as using any type of filter to alter or distort the delivered photos.  In doing so, you will be in breech of contract.

 

EXCLUSIVITY

It is understood and agreed that no other photographer will be allowed to photograph or take pictures while the Photographer is working. The Photographer shall be the exclusive photographer retained by the Client for the purpose of photographing the session. 

 

PHOTO REORDERING AND TIME FRAME/ARCHIVING

In order to keep organized and conserve space, your photos may be deleted or unavailable 30 days after your session has taken place, and you waive any and all claims against Photographer for the unavailability of such photos, even if you must replace them at your own cost. Therefore, it is recommended you download and keep your gallery in a safe place.

 

FINALIZATION

You will be contacted and made aware when your photos are ready, but it is your responsibility to check your email for your online gallery or retouched photos.

 

WAIVER AND INDEMNIFICATION

Client and its agents, family members, successors and assignees, if any, shall indemnify, and hold harmless, Angela Hall Photography and its managers, officers, directors, employees, contractors, and assignees from any and all claims for damages arising out of the performance of any of the services contemplated by this Agreement.

 

FINAL AGREEMENT AND AMENDMENTS

If Photographer cannot perform this agreement in whole or in part due to a cause beyond the control of the parties, changing of details that no longer fit with the photographers’ originally agreed terms or due to Photographer’s illness or injury, then Angela Hall Photography will return all fees to the client(s) and shall have no further liability to the Client.  This is the parties’ entire agreement on this matter, superseding all previous negotiations or agreements.  Any other terms must be agreed to in writing. Otherwise, the above terms will be considered the consolidated, exclusive terms between the parties.  This Agreement is governed by Texas law.  The sole venue for all disputes arising out of or in any way related to this Agreement, shall be in the State Court of Montgomery County, Texas.
